Welcome to Active DataComm. These Terms of Service (“Terms”) govern your use of the website https://callactive.com/ and our professional IT services (the “Service”) operated by Vitalcomm LLC d/b/a Active DataComm.

By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.


1. Professional IT Services & Remote Rescue

Active DataComm provides managed IT services, remote support, and website development.

  • Support Initiation: A request for support (via phone, email, or “Remote Rescue”) does not establish a recurring managed service contract unless a separate Service Level Agreement (SLA) is signed.

  • Authorization: By using our Remote Rescue service, you grant our technicians permission to access your computer system for the purpose of repair and maintenance.

2. SMS and MMS Messaging 

By providing your mobile number through our website forms or during the onboarding process, you agree to receive SMS/MMS notifications from Active DataComm regarding support tickets, service alerts, and administrative updates. Messaging may originate from our authorized numbers, including 662-584-5917, 662-620-7996, and 877-620-7996.

  • Consent: Consent is obtained through “double opt-in” via our web forms or by texting our support line directly.

  • Opt-Out: You may cancel the SMS service at any time. Just text “STOP” to our number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed.

  • Assistance: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance.

  • Liability: Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply.

3. Limitation of Liability (Your “Disclaimer” Protection)

In no event shall Vitalcomm LLC, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service.

  • Any unauthorized access to or use of our secure servers and/or any personal information stored therein.

  • Data Loss: While we provide backup solutions, the ultimate responsibility for data retention lies with the client unless specifically managed under an active backup agreement.

4. No Warranties (The “Disclaimer” Clause)

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Active DataComm does not warrant that:

  1. The Service will function uninterrupted or be available at any particular time or location.

  2. Any errors or defects will be corrected.

  3. The Service is free of viruses or other harmful components (though we utilize industry-standard security to prevent such issues).

5. Intellectual Property

The Service and its original content, features, and functionality (including the Active DataComm logo, website design, and proprietary code) are and will remain the exclusive property of Vitalcomm LLC and its licensors.
